These Terms govern your use of our website and your submission of inquiries and files. If you proceed with manufacturing services, project-specific terms (quotes, invoices, work orders, and written agreements) may also apply.
Terms for submissions and production
We work with brands, designers, and retailers on CAD review, prototyping, casting, finishing, polishing, stone setting, and related production services. These Terms help set expectations for file submissions, IP handling, quotes, and risk.
Overview
These Terms of Use (“Terms”) govern your access to and use of the Golden Casting website (“Site”) and related communications. By using the Site, submitting an inquiry, or uploading files, you agree to these Terms.
If you engage us for services, additional terms may apply, including quotes, invoices, work orders, statements of work, or a written manufacturing agreement (collectively, “Project Terms”). If Project Terms conflict with these Terms, the Project Terms control for that project.
Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site. If you use the Site on behalf of a company, you represent you have authority to bind that company to these Terms.
Website Use
- Use the Site lawfully and do not misuse, disrupt, or attempt to access restricted areas.
- Do not upload viruses, malware, or content intended to compromise systems.
- Do not copy, scrape, reverse-engineer, or exploit the Site in a way that harms Golden Casting or others.
Submissions & Uploaded Files
If you submit an inquiry or upload files (including CAD, STL, 3DM, STEP, images, PDFs, sketches, or notes), you represent that you own the content or have permission to share it for evaluation and project-related purposes.
You grant Golden Casting a limited, non-exclusive, worldwide license to use your submitted materials solely to:
- Review and assess manufacturability.
- Prepare quotes and communicate about your project.
- If you proceed, perform production, quality control, and delivery of services.
- Maintain internal records (e.g., job history, QC notes).
Intellectual Property
Your IP: As between you and Golden Casting, you retain ownership of the designs and files you submit, except for the limited license above.
Our IP: We retain ownership of our Site, processes, know-how, manufacturing methods, internal tooling, templates, documentation, and any pre-existing designs or assets we provide.
Improvements & feedback: If you provide feedback about the Site or services, you allow us to use it to improve our offerings without obligation to you.
Quotes, Pricing & Payments
Quotes are based on the information and files provided at the time of quoting. Pricing may change if requirements, metal markets, quantities, timelines, or specs change.
- Quotes may expire after a stated period (or a reasonable time if not stated).
- Certain projects may require deposits or milestone payments before work begins.
- Taxes, shipping, and third-party fees may be additional unless explicitly included.
Paid consultations (if offered) are billed as described at booking and are typically non-refundable once delivered.
Manufacturing Services & Lead Times
We may offer services including CAD review, prototyping, casting, finishing, polishing, stone setting, engraving, repairs, and related production support.
Lead times are estimates unless explicitly guaranteed in writing. Delays may occur due to scope changes, approvals, material availability, or force majeure events.
Revisions, Approvals & Production
If your project includes CAD design or revisions, you’re responsible for reviewing and approving deliverables before production. Once production begins (casting, setting, finishing), changes may not be possible or may require additional cost and time.
- You are responsible for confirming specs, dimensions, stone details, metal choice, ring size, and quantities.
- Manufacturing variation is inherent in production; minor tolerances and finishing variations may occur.
Shipping, Delivery & Risk of Loss
Shipping methods, insurance, and delivery details are handled per the Project Terms. Unless otherwise agreed in writing, risk of loss transfers upon delivery to the carrier or at pickup.
Disclaimers & Warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee the Site will be uninterrupted, error-free, or secure.
Limitation of Liability
To the fullest extent permitted by law, Golden Casting will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or business interruption.
To the fullest extent permitted by law, our total liability for any claim related to the Site or these Terms will not exceed the amount you paid to us (if any) for the relevant service giving rise to the claim, or $100 if no payment was made.
Some jurisdictions do not allow certain limitations, so these limits may not apply to you in full.
Indemnification
You agree to indemnify and hold harmless Golden Casting and its affiliates, officers, employees, and contractors from claims arising out of your use of the Site, your submissions, your breach of these Terms, or your violation of third-party rights (including IP rights).
Termination
We may suspend or terminate access to the Site if we reasonably believe you are violating these Terms or creating risk for Golden Casting or others.
Governing Law & Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
Any dispute arising from these Terms or the Site will be brought in state or federal courts located in New York County, New York, and you consent to jurisdiction and venue there.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and may provide additional notice where appropriate.
